General Terms and Conditions of Sale

PREAMBLE

These General Terms and Conditions of Sale govern the sale of tickets, the formation of the related contract, and the mutual rights and obligations of the Client, the Ticket Seller, and the Festival Organizer.

The term **Client** refers to the person in whose name or on whose behalf a ticket is reserved and/or who attends the event **“Kizomba Beach Festival.”**
The **Ticket Seller** is **your-tickets.be**.
The **Event Organizer** is **Horizons croisés asbl**, whose registered office is located at Rue de la Heid 32, 4920 Aywaille, Belgium, registered with the Crossroads Bank for Enterprises (BCE) under number **BE 1028.590.671**.

These General Terms and Conditions form an integral part of the contract resulting from the purchase of one or more ticket(s) for the event.

ARTICLE 1: SCOPE OF APPLICATION

By purchasing a ticket for the event, you expressly confirm, as an attendee, that you accept the Event’s General Terms and Conditions. Any breach of these rules will be sanctioned.

ARTICLE 2: BOOKING CONDITIONS

A ticket reservation becomes effective only after receipt of full payment by the Ticket Seller.

When purchasing ticket(s) via the Ticket Seller’s online platform, the reservation offer becomes effective only if the payment deadlines specified are respected.

Tickets purchased via the Ticket Seller’s online platform are downloadable and/or sent by email. Tickets must be printed by the Client on white paper in such a way that all information is perfectly legible. Printing costs are borne by the Client.

In all cases, service and administrative fees are definitively acquired by the Ticket Seller upon receipt of payment from the Client.

VAT and any other taxes are borne by the Client.

The natural person or legal entity making the reservation guarantees payment of the reservation, even when acting on behalf of third parties.

The right of withdrawal does not apply, as the service (ticket reservation) is provided immediately.

After payment, tickets are neither refundable nor exchangeable.

ARTICLE 3: LIABILITY

Horizons croisés asbl reserves the right to refuse access to the event site to any person if sufficient reasons justify such refusal. You are solely responsible for any breach of the rules. You also agree to indemnify Horizons croisés asbl against all possible consequences of your breach, including claims by third parties. We also reserve the right to take any necessary legal action.

Artists and organizers, their agents, and employees cannot be held liable under any circumstances for loss, damage, theft, or any other incident.

The official sale of event merchandise takes place exclusively on the event site or on its official website.

Event tickets are not valid transport tickets for trains or buses.

The organization of the event (including, but not limited to, programming, schedules, ticket prices, and the number of tickets offered for sale) is the sole responsibility of the Organizer. The Ticket Seller is only responsible for ticket sales and ticket delivery.

The Organizer’s liability is limited solely to direct damages suffered by a Client that are the direct and exclusive result of a fault attributable to the Organizer. Only damages covered by the Organizer’s insurance and compensated by the insurer will be considered.

In any event, the Organizer’s liability is limited to the amounts actually paid by the insurer. The following are excluded from compensation:
(i) indirect damages,
(ii) non-material damages, and
(iii) damages resulting from the Client’s intentional misconduct or gross negligence.

Entry to the event site is at the Client’s own risk. The Organizer declines all liability for damages resulting from entry to the site and/or participation in activities, such as hearing, vision, or other bodily issues.

Program changes do not give rise to any partial or total refund. The Organizer cannot be held liable for the absence or delay of any artist announced on promotional materials.

In the event of cancellation due to force majeure or restrictions and/or prohibitions on audience attendance due to force majeure, no penalties or compensation of any kind may be claimed from the Organizer under applicable Belgian law.

“Force majeure” means any insurmountable event beyond the Organizer’s control that prevents the Organizer from fulfilling its obligations.

Acts of public authorities—such as requisitions, prohibitions, restrictions, police measures, etc.—that legally prevent the Organizer from fulfilling its contractual obligations are also considered force majeure. In such cases, the Organizer’s liability is excluded, and tickets are neither refunded nor exchanged.

ARTICLE 4: CONDITIONS OF USE

Access to the event is subject to validation of your e-ticket. The e-ticket may be presented in printed form or electronically on a smartphone. It is valid only for the location and date specified on the ticket.

This e-ticket is subject to the general terms and conditions of Your-tickets.be and, where applicable, those of the Organizer accepted at the time of purchase. The e-ticket is personal, non-exchangeable, and non-refundable. Loss or theft of a ticket is the responsibility of the purchaser and does not entitle them to replacement or refund.

Tickets may not be resold. Resold tickets do not grant access to the event. If the Organizer detects tickets being offered for resale, it reserves the right to cancel them and refuse access to the bearer without refund.

Each e-ticket contains a unique barcode allowing access to the event for one person only. Only the first ticket holder will be granted access. The purchaser remains responsible for the use of the e-tickets.

Do not purchase tickets from unknown individuals, as there is no guarantee of validity. In the event of loss, theft, or duplication of a valid ticket, Your-tickets.be declines all responsibility for its fraudulent use.

Festival tickets may not be used for commercial or promotional purposes without prior authorization from the Organizer.

In the event of cancellation or postponement of the event, ticket refunds will be subject to the Organizer’s conditions. Photography, filming, and recording during the event are prohibited. Events take place under the sole responsibility of the Organizer.

ARTICLE 5: SECURITY

For security reasons, organizers reserve the right to conduct searches at the entrance to the event site. Any Client refusing to comply will be denied access. The Client must follow security staff instructions at all times.

If a Client notices suspicious behavior from another Client or a third party, they are invited to inform security staff. Organizers reserve the right to refuse access to any Client whose behavior could compromise their own safety or that of others.

For compelling and demonstrable security reasons, or upon advice from authorities, the Organizer reserves the right to:

* suspend or terminate the event;
* temporarily keep Clients on the event site until further notice;
* request Clients to leave the event site.

In such cases, tickets are neither refunded nor exchanged.

No ticket refund is possible if a Client chooses to cancel attendance due to concerns such as threats or terrorist attacks.

ARTICLE 6: PROHIBITIONS

It is forbidden to bring onto the event site: professional cameras or recording equipment; alcoholic beverages; glass objects; fireworks; weapons; sharp objects; any object deemed dangerous by the organizers; animals (except guide dogs for the visually impaired); electrical appliances; sound or music amplification equipment; gas burners, stoves, or explosives; aerosols; and any illegal or prohibited substances. All such items will be confiscated by security. Lighting fires is strictly prohibited.

ARTICLE 7: SALES ON THE EVENT SITE

Without prior written authorization from the Organizer, the sale of food, drinks, souvenirs, T-shirts, or any other items is strictly prohibited.

ARTICLE 8: SEVERABILITY

The failure of the organizers to enforce any provision of these terms shall not be interpreted as a waiver of the right to enforce it. The invalidity of any clause shall not affect the validity of the remaining clauses.

ARTICLE 9: JURISDICTION AND APPLICABLE LAW

In the event of a dispute, only the courts of the judicial district of Liège, where Horizons croisés asbl has its registered office, shall have jurisdiction. Belgian law shall be the sole applicable law.
