Conditions Générales de Vente
PRÉAMBULE
Les présentes Conditions Générales de vente régissent la vente de billets, la naissance du contrat y afférent et les droits et obligations mutuelles du/de la Client•e, du Vendeur de billets et de l’Organisateur du Festival.
•	Le terme Client•e désigne la personne au nom de laquelle ou pour le compte de laquelle un billet est réservé et/ou qui se rend à l’événement « Mega Beach Festival ».
•	Le Vendeur de billets est your-tickets.be
•	L’Organisateur de l’événement est Maman Woria asbl, dont le siège social est situé à 1400 Nivelles, rue du Levant, 4/1, inscrite à la BCE sous le numéro BE 0805.400.797
Les présentes Conditions Générales font partie intégrante du contrat résultant de la commande
d’un ou plusieurs billet(s) pour l’événement.
ARTICLE 1 : CHAMP D’APPLICATION
En achetant un ticket de l’événement, vous confirmez expressément en tant que visiteur•euse, accepter les Conditions Générales de l’Événement. Chaque manquement à ce règlement sera sanctionné.
ARTICLE 2 : MODALITES DE RESERVATION
La réservation d’un billet n’est effective qu’après réception du paiement de la somme due par le Vendeur de billets.
Lors de l’achat d’un (de) billet(s) via la plateforme online du Vendeur de billets, l’offre de réservation ne sera effective que dans la mesure où les délais de paiement mentionnés auront été respectés.
Les billets achetés via la plateforme online du Vendeur de billets sont téléchargeables et/ou envoyés par mail. Les billets doivent être imprimés par le•a Client•e sur un papier blanc et de manière à permettre que l’ensemble des informations s’y trouvant soient parfaitement lisibles. Les frais d’impression sont à charge du / de la Client•e.
Dans tous les cas, les frais de service et d’administration sont définitivement acquis par le Vendeur de billets dès réception du paiement de la somme due par le Client.
La TVA et autres taxes sont à la charge du/de la Client•e.
La personne physique ou la société qui effectue la réservation se porte garant du paiement de la réservation, même lorsqu’elle agit pour le compte de tiers.
Le droit de rétractation n’est pas d’application, étant donné que le service (réservation du billet) est effectué immédiatement.
Après paiement, le billet n’est ni remboursable ni échangeable.
ARTICLE 3 : RESPONSABILITÉ
Maman Woria asbl se réserve le droit de refuser l’accès au site à toute personne dans le cas où des raisons suffisantes le justifient. Vous êtes la seule personne responsable en cas de manquement au règlement. Vous êtes également tenu•e de garantir Maman Woria asbl contre toutes les conséquences possibles de votre manquement, y compris les revendications de tiers. Nous conservons en outre le droit de prendre nous-mêmes les mesures judiciaires nécessaires. Les artistes et les organisateur•ices, leurs agents et leurs employé•es ne peuvent en aucun cas être tenus comme responsables pour des pertes, des dégâts ou des vols, ni en cas de tout autre événement. La vente officielle de produits dérivés de l’événement a lieu uniquement sur le terrain de l’événement ou sur son site internet.
Les tickets pour l’événement ne sont pas des titres de transports valables pour le train ou le bus.
L’organisation de l’événement (en ce compris, mais de façon non limitative, la programmation, les horaires, le prix des billets et le nombre de billets mis en vente) relève de la responsabilité de l’Organisateur. Le Vendeur de billets est uniquement responsable de la vente des billets et de l’envoi de ceux-ci.
La responsabilité de l’Organisateur n’est engagée que pour les dommages directs qu’un•e Client.e pourrait subir, et qui seraient la conséquence directe et exclusive d’un manquement imputable à l’Organisateur. Ne sont pris en compte pour un quelconque dédommagement que les dommages pour lesquels l’Organisateur est assuré et qui font l’objet d’un dédommagement par l’assureur.
La responsabilité de l’Organisateur est en toute hypothèse limitée aux montants qui seront effectivement payés par l’assureur. Ne sont pas pris en compte pour un dédommagement : (i) dommages indirects, (ii) dommages immatériels et (iii) dommages consécutifs à la volonté ou à l’imprudence délibérée du Client.
L’entrée sur le site de l’événement se fait aux risques du / de la Client•e. L’Organisateur décline toute responsabilité pour les dommages consécutifs à l’entrée en question sur le site et/ou au fait d’assister aux activités, par exemple des problèmes d’audition, de vue et autres problèmes corporels.
Les modifications de programmation ne donnent pas lieu à un remboursement, ni partiel ni total, du billet. L’Organisateur ne peut en aucun cas être tenu responsable de l’absence ou du retard de l’un ou l’autre des artistes annoncés sur les supports promotionnels de l’événement.
En cas d’annulation de l’événement pour cas de force majeure ou en cas d’interdiction et/ou de limitation de la présence de spectateur•ices à l’événement pour cas de force majeure, aucune pénalité et aucune indemnité de quelque nature ne pourra être réclamée à l’Organisateur aux dispositions du droit belge applicable.
Il faut entendre par « cas de force majeure » tout événement insurmontable, indépendant de toute faute de l’Organisateur et qui empêche l’Organisateur d’exécuter ses obligations.
Est assimilé à un « cas de force majeure » tout acte de l’autorité publique– réquisitions, interdictions, empêchements, mesures de police, etc. – qui empêche juridiquement l’Organisateur d’effectuer les prestations auxquelles il est tenu contractuellement.  Dans ce cas, la responsabilité de l’Organisateur est exclue. Les tickets ne sont ni remboursés ni échangés.
ARTICLE 4 : CONDITIONS D’UTILISATION
L’accès à l’évènement est soumis au contrôle de validité de votre e-ticket. Vous pouvez présenter ce e-ticket imprimé ou en version électronique sur smartphone. Il est uniquement valable pour le lieu et la date précisés sur le ticket. Ce e-ticket est soumis aux conditions générales de vente de Your-tickets.be, et le cas échéant à celles de l’Organisateur que vous avez acceptées lors de la commande.  Ce e-ticket n’est ni échangeable, ni remboursable et est personnel. La perte ou le vol du ticket est de la responsabilité de l’acheteur•euse et ne donnera pas lieu à un remplacement ou remboursement.
Les billets ne peuvent être revendus. Les billets revendus ne donnent pas le droit d’entrée à l’événement. Si l’Organisateur constate que des billets sont proposés à la vente, il se réserve le droit d’annuler ces billets et de refuser l’accès à l’événement à leur porteur, sans droit à restitution du prix d’achat des billets.  Chaque e-ticket est muni d’un code barre unique permettant l’accès à l’événement à une seule personne.  Seule la première personne détentrice du billet pourra accéder à l’événement. L’acheteur•euse demeure responsable de l’utilisation qui est faite des e-tickets.
N’achetez pas ce billet à un•e inconnu•e, vous n’auriez aucune garantie de validité. En cas de perte, de vol ou de duplication d’un billet valide, Your-tickets.be décline toute responsabilité sur l’utilisation illicite de ce billet. Les tickets de festival ne peuvent être utilisés à des fins commerciales ou promotionnelles sans l’autorisation de l’Organisateur.
En cas d’annulation ou de report de l’événement, le remboursement de ce billet sera soumis aux conditions de l’Organisateur de l’événement. Il est interdit de photographier, filmer ou enregistrer lors de l’événement. Les événements se déroulent sous la seule responsabilité de l’Organisateur.
ARTICLE 5 : SECURITÉ
Pour des raisons de sécurité les organisateur•ices se réservent le droit d’effectuer une fouille à l’entrée du site de l’événement.  Tout•e client.e ne se soumettant pas à cette formalité se verra refuser l’accès au site de l’événement. Le•a Client.e suivra les consignes des agents de sécurité à tout moment.  Dans l’hypothèse où un•e client•e remarque un comportement suspect d’un•e autre client•e ou d’un tiers, il/elle est invité•e à en informer les agents de sécurité. Les organisateur•ices se réservent le droit de refuser l’accès au site à tout•e client•e dont le comportement pourrait nuire à sa sécurité ou à celle de tiers.  En outre, pour une raison de sécurité impérieuse et démontrable ou sur simple conseil des autorités, l’Organisateur se réserve le droit de :
– suspendre l’événement ou d’y mettre fin ;
– maintenir provisoirement et jusqu’à nouvel ordre les client•es sur le site de l’événement ;
– demander aux client•es de quitter le site de l’événement.
Dans ce cas, les billets ne sont pas remboursés, ni échangés.
Le remboursement du billet pour l’événement n’est en aucun cas possible si un•e Client•e souhaite annuler son billet d’entrée à la suite d’une inquiétude relative, par exemple, à une menace et/ou à des attentats terroristes, …
ARTICLE 6 : INTERDICTIONS
Il est interdit d’emporter sur le site de l’événement des appareils photos, caméras ou enregistreurs professionnels, des boissons alcoolisées, des objets en verre, des feux d’artifice, des armes, des objets tranchants ou tout autre objet pouvant être considéré comme dangereux par les organisateur•ices, tout animal (sauf les chiens accompagnateurs de personnes malvoyantes), tout appareil électrique, toute sonorisation ou amplification de musique, les becs de gaz, réchaud ou autre explosif, les aérosols, toute substance illicite/interdite par la loi. Tous ces objets seront confisqués par la sécurité. Il est expressément interdit d’allumer un feu.
ARTICLE 7 : VENTES SUR LE SITE DE L’EVENEMENT
En l’absence d’une autorisation écrite préalable de l’Organisateur, toute vente de nourriture, boissons, souvenirs, T-shirt ou autre est strictement interdite.
ARTICLE 8 : INDÉPENDANCE DES CLAUSES
Le fait pour les organisateur•ices de ne pas mettre en œuvre l’une ou l’autre clause des présentes conditions ne peut être interprété comme une renonciation de sa part à s’en prévaloir.  De même, la nullité éventuelle d’une clause des présentes conditions n’affecte pas la validité des autres clauses.
ARTICLE 9 : COMPÉTENCE ET DROIT APPLICABLE
En cas de litige, seuls les tribunaux de l’arrondissement judiciaire du Brabant wallon dans lequel Maman Woria asbl a son siège social sont compétents.  Le droit belge est le seul droit applicable.

General Terms and Conditions of Sale
PREAMBLE
These General Terms and Conditions of Sale govern the sale of tickets, the formation of the related contract, and the mutual rights and obligations of the Customer, the Ticket Seller, and the Festival Organizer.
The term Customer refers to the person in whose name or on whose behalf a ticket is reserved and/or who attends the “Mega Beach Festival” event.
The Ticket Seller is your-tickets.be.
The Event Organizer is Maman Woria asbl, whose registered office is located at rue du Levant 4/1, 1400 Nivelles, registered with the Crossroads Bank for Enterprises under number BE 0805.400.797.
These General Terms and Conditions form an integral part of the contract resulting from the order of one or more ticket(s) for the event.
ARTICLE 1: SCOPE OF APPLICATION
By purchasing a ticket for the event, you expressly confirm, as an attendee, that you accept the General Terms and Conditions of the Event. Any breach of these rules will be sanctioned.
ARTICLE 2: BOOKING TERMS
A ticket reservation becomes effective only after receipt of payment of the amount due by the Ticket Seller.
When purchasing ticket(s) via the Ticket Seller’s online platform, the booking offer will only be effective provided that the stated payment deadlines are respected.
Tickets purchased via the Ticket Seller’s online platform are downloadable and/or sent by email. Tickets must be printed by the Customer on white paper in such a way that all information on them is perfectly legible. Printing costs are borne by the Customer.
In all cases, service and administrative fees are definitively acquired by the Ticket Seller upon receipt of payment of the amount due by the Customer.
VAT and other taxes are borne by the Customer.
The natural person or company making the reservation guarantees payment of the reservation, even when acting on behalf of third parties.
The right of withdrawal does not apply, as the service (ticket reservation) is provided immediately.
After payment, the ticket is neither refundable nor exchangeable.
ARTICLE 3: LIABILITY
Maman Woria asbl reserves the right to refuse access to the site to any person where sufficient reasons justify such refusal. You are solely responsible in the event of non-compliance with the rules. You are also required to indemnify Maman Woria asbl against all possible consequences of your breach, including claims by third parties. We further reserve the right to take any necessary legal action ourselves.
Artists and organizers, their agents and employees, cannot under any circumstances be held liable for losses, damage, or theft, nor for any other incident. The official sale of event merchandise takes place exclusively on the event site or on its official website.
Event tickets are not valid as transport tickets for trains or buses.
The organization of the event (including, but not limited to, programming, schedules, ticket prices, and the number of tickets offered for sale) falls under the responsibility of the Organizer. The Ticket Seller is solely responsible for ticket sales and delivery.
The Organizer’s liability is engaged only for direct damages that a Customer may suffer, which are the direct and exclusive result of a fault attributable to the Organizer. Only damages for which the Organizer is insured and which are compensated by the insurer are eligible for any compensation.
In any event, the Organizer’s liability is limited to the amounts actually paid by the insurer. The following are excluded from compensation:
(i) indirect damages,
(ii) non-material damages, and
(iii) damages resulting from the intentional or reckless conduct of the Customer.
Entry to the event site is at the Customer’s own risk. The Organizer declines all liability for damage resulting from entry to the site and/or participation in activities, such as hearing, vision, or other bodily issues.
Changes to the program do not entitle the Customer to a partial or full refund of the ticket. The Organizer cannot under any circumstances be held liable for the absence or delay of any artist announced on promotional materials.
In the event of cancellation of the event due to force majeure or in the event of prohibition and/or limitation of audience attendance due to force majeure, no penalty or compensation of any kind may be claimed from the Organizer under applicable Belgian law.
“Force majeure” means any insurmountable event, independent of any fault of the Organizer, that prevents the Organizer from fulfilling its obligations.
Acts of public authorities—requisitions, prohibitions, impediments, police measures, etc.—that legally prevent the Organizer from performing its contractual obligations are also considered force majeure. In such cases, the Organizer’s liability is excluded. Tickets are neither refunded nor exchanged.
ARTICLE 4: CONDITIONS OF USE
Access to the event is subject to verification of the validity of your e-ticket. You may present this e-ticket printed or in electronic form on a smartphone. It is valid only for the location and date specified on the ticket.
This e-ticket is subject to the general terms and conditions of sale of Your-tickets.be and, where applicable, those of the Organizer accepted at the time of purchase. The e-ticket is personal, non-exchangeable, and non-refundable. Loss or theft of the ticket is the responsibility of the purchaser and does not give rise to replacement or refund.
Tickets may not be resold. Resold tickets do not grant access to the event. If the Organizer finds that tickets are offered for resale, it reserves the right to cancel them and refuse access to the bearer, without refund of the purchase price.
Each e-ticket contains a unique barcode allowing access to the event for one person only. Only the first holder of the ticket will be granted access. The purchaser remains responsible for the use of the e-tickets.
Do not purchase this ticket from an unknown person, as its validity cannot be guaranteed. In the event of loss, theft, or duplication of a valid ticket, Your-tickets.be declines all responsibility for any unlawful use of the ticket.
Festival tickets may not be used for commercial or promotional purposes without the Organizer’s authorization.
In the event of cancellation or postponement of the event, ticket refunds will be subject to the Organizer’s conditions. Photography, filming, or recording during the event is prohibited. Events take place under the sole responsibility of the Organizer.
ARTICLE 5: SECURITY
For security reasons, the organizers reserve the right to conduct searches at the entrance to the event site. Any Customer refusing to comply will be denied access. The Customer must follow the instructions of security staff at all times.
If a Customer notices suspicious behavior by another Customer or a third party, they are invited to inform security staff. The organizers reserve the right to refuse access to any Customer whose behavior may jeopardize their own safety or that of others.
Furthermore, for compelling and demonstrable security reasons or upon advice from the authorities, the Organizer reserves the right to:
suspend or terminate the event;
temporarily keep Customers on the event site until further notice;
request Customers to leave the event site.
In such cases, tickets are neither refunded nor exchanged.
Under no circumstances will a ticket be refunded if a Customer chooses to cancel due to concerns such as threats and/or terrorist attacks.
ARTICLE 6: PROHIBITIONS
It is prohibited to bring onto the event site professional cameras, video cameras, or recording devices; alcoholic beverages; glass objects; fireworks; weapons; sharp objects or any object deemed dangerous by the organizers; animals (except guide dogs for visually impaired persons); electrical devices; sound or music amplification equipment; gas burners, stoves, or other explosive devices; aerosols; and any illicit or illegal substances. All such items will be confiscated by security. Lighting fires is strictly prohibited.
ARTICLE 7: SALES ON THE EVENT SITE
Without prior written authorization from the Organizer, any sale of food, beverages, souvenirs, T-shirts, or other items is strictly prohibited.
ARTICLE 8: SEVERABILITY
The failure of the organizers to enforce any clause of these terms shall not be interpreted as a waiver of their right to invoke it. Likewise, the potential invalidity of any clause does not affect the validity of the remaining clauses.
ARTICLE 9: JURISDICTION AND APPLICABLE LAW
In the event of a dispute, only the courts of the judicial district of Walloon Brabant in which Maman Woria asbl has its registered office shall have jurisdiction. Belgian law is the sole applicable law.

Algemene Verkoopvoorwaarden
PREAMBULE
Deze Algemene Verkoopvoorwaarden regelen de verkoop van tickets, het ontstaan van de daarmee samenhangende overeenkomst en de wederzijdse rechten en verplichtingen van de Klant, de Ticketverkoper en de Organisator van het Festival.
De term Klant verwijst naar de persoon op wiens naam of voor wiens rekening een ticket wordt gereserveerd en/of die het evenement “Mega Beach Festival” bijwoont.
De Ticketverkoper is your-tickets.be.
De Organisator van het evenement is Maman Woria vzw, met maatschappelijke zetel te 1400 Nijvel, Levantstraat 4/1, ingeschreven in de Kruispuntbank van Ondernemingen onder nummer BE 0805.400.797.
Deze Algemene Verkoopvoorwaarden maken integraal deel uit van de overeenkomst die voortvloeit uit de bestelling van één of meerdere ticket(s) voor het evenement.
ARTIKEL 1: TOEPASSINGSGEBIED
Door een ticket voor het evenement te kopen, bevestigt u uitdrukkelijk als bezoeker dat u de Algemene Voorwaarden van het Evenement aanvaardt. Elke inbreuk op dit reglement zal worden gesanctioneerd.
ARTIKEL 2: RESERVERINGSVOORWAARDEN
Een ticketreservering is pas definitief na ontvangst van de betaling van het verschuldigde bedrag door de Ticketverkoper.
Bij aankoop van ticket(s) via het online platform van de Ticketverkoper wordt het reserveringsaanbod slechts definitief voor zover de vermelde betalingstermijnen worden nageleefd.
Tickets die via het online platform van de Ticketverkoper worden aangekocht, zijn downloadbaar en/of worden per e-mail verzonden. De tickets moeten door de Klant worden afgedrukt op wit papier, zodanig dat alle vermelde informatie perfect leesbaar is. De afdrukkosten zijn ten laste van de Klant.
In alle gevallen zijn de service- en administratiekosten definitief verworven door de Ticketverkoper vanaf de ontvangst van de betaling van het door de Klant verschuldigde bedrag.
De btw en andere belastingen zijn ten laste van de Klant.
De natuurlijke persoon of de vennootschap die de reservering uitvoert, staat garant voor de betaling van de reservering, zelfs wanneer hij/zij handelt voor rekening van derden.
Het herroepingsrecht is niet van toepassing, aangezien de dienst (ticketreservering) onmiddellijk wordt geleverd.
Na betaling is het ticket niet terugbetaalbaar en niet omruilbaar.
ARTIKEL 3: AANSPRAKELIJKHEID
Maman Woria vzw behoudt zich het recht voor om de toegang tot het terrein te weigeren aan elke persoon indien daarvoor voldoende redenen bestaan. U bent als enige verantwoordelijk in geval van niet-naleving van het reglement. U verbindt zich er tevens toe Maman Woria vzw te vrijwaren tegen alle mogelijke gevolgen van uw inbreuk, met inbegrip van vorderingen van derden. Wij behouden ons bovendien het recht voor om zelf de nodige gerechtelijke stappen te ondernemen.
De artiesten en organisatoren, hun agenten en werknemers kunnen in geen geval aansprakelijk worden gesteld voor verlies, schade of diefstal, noch voor enig ander voorval. De officiële verkoop van merchandising van het evenement vindt uitsluitend plaats op het evenemententerrein of via de officiële website.
Tickets voor het evenement zijn geen geldige vervoersbewijzen voor trein of bus.
De organisatie van het evenement (met inbegrip van, maar niet beperkt tot, de programmatie, de uurroosters, de ticketprijzen en het aantal beschikbare tickets) valt onder de verantwoordelijkheid van de Organisator. De Ticketverkoper is uitsluitend verantwoordelijk voor de verkoop en verzending van de tickets.
De aansprakelijkheid van de Organisator is enkel van toepassing op de directe schade die een Klant zou lijden en die het rechtstreekse en exclusieve gevolg is van een aan de Organisator toerekenbare tekortkoming. Enkel schade waarvoor de Organisator verzekerd is en die door de verzekeraar wordt vergoed, komt in aanmerking voor een eventuele schadevergoeding.
De aansprakelijkheid van de Organisator is in elk geval beperkt tot de bedragen die daadwerkelijk door de verzekeraar worden uitgekeerd. De volgende schade komt niet in aanmerking voor vergoeding:
(i) indirecte schade,
(ii) immateriële schade, en
(iii) schade voortvloeiend uit opzettelijk of roekeloos gedrag van de Klant.
De toegang tot het evenemententerrein gebeurt op eigen risico van de Klant. De Organisator wijst elke aansprakelijkheid af voor schade die voortvloeit uit het betreden van het terrein en/of het bijwonen van de activiteiten, zoals gehoor-, gezichts- of andere lichamelijke problemen.
Wijzigingen in het programma geven geen recht op een gedeeltelijke of volledige terugbetaling van het ticket. De Organisator kan in geen geval aansprakelijk worden gesteld voor de afwezigheid of vertraging van één of meerdere artiesten die op promotioneel materiaal worden aangekondigd.
In geval van annulering van het evenement wegens overmacht of in geval van een verbod en/of beperking van de aanwezigheid van toeschouwers wegens overmacht, kan geen enkele boete of schadevergoeding van welke aard ook worden geëist van de Organisator overeenkomstig het toepasselijke Belgische recht.
Onder “overmacht” wordt verstaan elke onoverkomelijke gebeurtenis, onafhankelijk van enige fout van de Organisator, die de Organisator verhindert zijn verplichtingen na te komen.
Worden eveneens als “overmacht” beschouwd: elke handeling van de overheid – vorderingen, verboden, belemmeringen, politiemaatregelen, enz. – die de Organisator juridisch verhindert zijn contractuele verplichtingen na te komen. In dat geval is de aansprakelijkheid van de Organisator uitgesloten. Tickets worden niet terugbetaald en niet omgeruild.
ARTIKEL 4: GEBRUIKSVOORWAARDEN
De toegang tot het evenement is onderworpen aan de controle van de geldigheid van uw e-ticket. U kunt dit e-ticket afgedrukt of in elektronische vorm op een smartphone voorleggen. Het is uitsluitend geldig voor de plaats en de datum vermeld op het ticket.
Dit e-ticket is onderworpen aan de algemene verkoopvoorwaarden van Your-tickets.be en, in voorkomend geval, aan die van de Organisator die u bij de bestelling hebt aanvaard. Het e-ticket is persoonlijk, niet omruilbaar en niet terugbetaalbaar. Verlies of diefstal van het ticket valt onder de verantwoordelijkheid van de koper en geeft geen recht op vervanging of terugbetaling.
Tickets mogen niet worden doorverkocht. Doorverkochte tickets geven geen recht op toegang tot het evenement. Indien de Organisator vaststelt dat tickets te koop worden aangeboden, behoudt hij zich het recht voor deze tickets te annuleren en de toegang tot het evenement te weigeren aan de houder ervan, zonder recht op terugbetaling van de aankoopprijs.
Elk e-ticket is voorzien van een unieke barcode die toegang verleent aan één persoon. Enkel de eerste houder van het ticket krijgt toegang tot het evenement. De koper blijft verantwoordelijk voor het gebruik van de e-tickets.
Koop dit ticket niet van een onbekende, aangezien er geen enkele garantie is op de geldigheid ervan. In geval van verlies, diefstal of duplicatie van een geldig ticket wijst Your-tickets.be elke aansprakelijkheid af voor het onrechtmatig gebruik ervan.
Festivaltickets mogen niet worden gebruikt voor commerciële of promotionele doeleinden zonder toestemming van de Organisator.
In geval van annulering of uitstel van het evenement is de terugbetaling van het ticket onderworpen aan de voorwaarden van de Organisator. Het is verboden om tijdens het evenement te fotograferen, filmen of op te nemen. De evenementen vinden plaats onder de uitsluitende verantwoordelijkheid van de Organisator.
ARTIKEL 5: VEILIGHEID
Om veiligheidsredenen behouden de organisatoren zich het recht voor om aan de ingang van het evenemententerrein controles uit te voeren. Elke Klant die zich hieraan niet onderwerpt, zal de toegang tot het terrein worden geweigerd. De Klant dient te allen tijde de instructies van de veiligheidsagenten op te volgen.
Indien een Klant verdacht gedrag opmerkt van een andere Klant of van een derde, wordt hij/zij verzocht dit te melden aan de veiligheidsagenten. De organisatoren behouden zich het recht voor om de toegang te weigeren aan elke Klant wiens gedrag zijn eigen veiligheid of die van anderen in gevaar zou kunnen brengen.
Bovendien behoudt de Organisator zich, om dwingende en aantoonbare veiligheidsredenen of op eenvoudig advies van de autoriteiten, het recht voor om:
het evenement te schorsen of stop te zetten;
de Klanten tijdelijk en tot nader order op het evenemententerrein te houden;
de Klanten te verzoeken het evenemententerrein te verlaten.
In deze gevallen worden de tickets niet terugbetaald en niet omgeruild.
Een terugbetaling van het ticket is in geen geval mogelijk indien een Klant zijn toegangsticket wenst te annuleren naar aanleiding van bezorgdheid over bijvoorbeeld een dreiging en/of terroristische aanslagen.
ARTIKEL 6: VERBODEN
Het is verboden om het evenemententerrein te betreden met professionele fotoapparatuur, camera’s of opnameapparatuur; alcoholische dranken; glazen voorwerpen; vuurwerk; wapens; scherpe voorwerpen of enig ander voorwerp dat door de organisatoren als gevaarlijk kan worden beschouwd; dieren (met uitzondering van geleidehonden voor slechtzienden); elektrische toestellen; geluids- of muziekversterkingsapparatuur; gasbranders, kooktoestellen of andere explosieven; spuitbussen; en elke illegale of wettelijk verboden substantie. Al deze voorwerpen zullen door de veiligheidsdienst in beslag worden genomen. Het is uitdrukkelijk verboden vuur te maken.
ARTIKEL 7: VERKOOP OP HET EVENEMENTENTERREIN
Bij gebrek aan voorafgaande schriftelijke toestemming van de Organisator is elke verkoop van voedsel, dranken, souvenirs, T-shirts of andere goederen strikt verboden.
ARTIKEL 8: ONAFHANKELIJKHEID VAN DE BEPALINGEN
Het feit dat de organisatoren één of meerdere bepalingen van deze voorwaarden niet toepassen, kan niet worden geïnterpreteerd als een afstand van het recht om zich er later op te beroepen. Evenzo tast de eventuele nietigheid van een bepaling de geldigheid van de overige bepalingen niet aan.
ARTIKEL 9: BEVOEGDHEID EN TOEPASSELIJK RECHT
In geval van een geschil zijn uitsluitend de rechtbanken van het gerechtelijk arrondissement Waals-Brabant waarin Maman Woria vzw haar maatschappelijke zetel heeft bevoegd. Het Belgische recht is het enige toepasselijke recht.
